Terms of Use

These Terms of Use (“Terms” or “EULA”) constitute a legal agreement between you (“End-User”) and Code Sorcery (“we,” “us,” or “our”) for the use of the Dreamz mobile application (“the Licensed Application”). By downloading, installing, or using the Licensed Application, you agree to these Terms.
1. Acknowledgement
You and Code Sorcery acknowledge that this EULA is concluded between you and Code Sorcery only, and not with Apple Inc. (“Apple”). Code Sorcery, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA does not provide for usage rules that are in conflict with the Apple Media Services Terms and Conditions.
2. Scope of License
The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
Use of the App
Dreamz is designed for parents and caregivers to create personalized bedtime stories for their children. You must be at least 18 years old to create an account and use the App. You are responsible for all activity that occurs under your account.
Subscriptions
Dreamz offers auto-renewable subscription plans (Bronze and Silver) that provide access to additional features. By subscribing, you agree to the following:
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
Current subscription prices are displayed in the App. Prices may vary by region and are subject to change.
AI-generated content
Stories created by the App are generated using artificial intelligence. While we implement multiple safety layers to ensure content is age-appropriate and gentle, AI-generated content may occasionally produce unexpected results. We encourage parents to read stories with or before their children.
User content
You retain ownership of the information you provide (child profiles, story inputs). By using the App, you grant us a limited license to process this information solely for the purpose of generating stories and providing the service.
Prohibited uses
You agree not to:
- Use the App for any unlawful purpose
- Attempt to circumvent any safety or content moderation measures
- Share your account credentials with others
- Use the App to generate content that is harmful, abusive, or inappropriate for children
3. Maintenance and Support
Code Sorcery is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
4. Warranty
Code Sorcery is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Code Sorcery’s sole responsibility.
The Licensed Application is provided “as is” and “as available” without additional warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
5. Product Claims
You and Code Sorcery acknowledge that Code Sorcery, not Apple, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit Code Sorcery’s liability to you beyond what is permitted by applicable law.
6. Intellectual Property Rights
You and Code Sorcery acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party’s intellectual property rights, Code Sorcery, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Limitation of liability
To the maximum extent permitted by law, Code Sorcery shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Termination
We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App and delete your account at any time by contacting us.
8. Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application, including your wireless data service agreement and any other applicable agreements with third-party service providers.
9. Third-Party Beneficiary
You and Code Sorcery acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
Changes to these Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the “Last updated” date. Continued use of the App after changes constitutes acceptance of the updated Terms.
